Agreement Between User and the Site

Welcome to the Site. This website (the "Site") is comprised of various web pages operated by Microcosm Media, LLC ("we," "us," "our"), including tofua.org, pedrotofua.org, and all related domains, subdomains, and affiliated properties. The Site is offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein (the "Terms"). Your use of the Site constitutes your agreement to all such Terms. Please read these Terms carefully.

The Site is a digital media platform dedicated to spiritual, educational, and cultural content. We provide several forms of digital content, including, but not limited to: online content, email newsletters, podcasts, books, guides, educational content, in-person gatherings, and social media content.

Definition of Covered Parties

For purposes of this Agreement, "Covered Parties" means Microcosm Media, LLC, its owners, officers, directors, members, employees, agents, volunteers, hosts, co-hosts, representatives, affiliates, affiliated initiatives, stewards, carriers, contractors, advisors, and any individuals or entities associated with the creation, delivery, or facilitation of the Services or gatherings, whether currently or formerly involved.

This definition applies throughout these Terms wherever protections, indemnification, releases, or disclaimers reference Covered Parties.

Definition of Services

For purposes of this Agreement, "Services" means all products, content, media, gatherings, programs, newsletters, websites, and other offerings provided by Microcosm Media, LLC, whether free or paid.

Privacy

Your use of the Site is subject to our Privacy Policy. Please review our Privacy Policy, which also governs the Site and informs users of our data collection practices.

Electronic Communications

Visiting the Site, member areas, or related subdomains, subscribing to newsletters, sharing your email or other contact information with us, clicking buttons on the Site, or sending emails to us constitutes electronic communications. You consent to receive electronic communications and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically, via email and on the Site, satisfy any legal requirement that such communications be in writing.

In addition, by subscribing to newsletters, sharing your email or other contact information with us, clicking buttons on the Site, or signing up for memberships or premium content, you agree that you "opt-in" to receive email communications from us.

Children and Age Restrictions

The Site does not knowingly collect, either online or offline, personal information from persons under the age of thirteen.

Age Requirements:

Online Content: Users must be 14 years or older to access online content, newsletters, or affiliated services. Users aged 14-17 must have permission from a parent or guardian. You agree to indemnify and hold harmless Microcosm Media, LLC and all Covered Parties for any use of the Site or newsletters by individuals under the age of 14 or by minors without parental consent.
In-Person Gatherings: Participants must be 18 years or older to attend any in-person gathering, event, or residency. You agree to indemnify and hold harmless Microcosm Media, LLC and all Covered Parties for any use of in-person services by individuals under the age of 18.

The Site targets its content and advertising to individuals over the age of 18.

Links to Third Party Sites/Third Party Services

The Site and/or newsletters may contain links to other websites ("Linked Sites"). The Linked Sites are not under the control of Microcosm Media, LLC, and we are not responsible for the contents of any Linked Site, including without limitation any link contained in a Linked Site, or any changes or updates to a Linked Site. We are providing these links to you only as a convenience, and the inclusion of any link does not imply endorsement by us of the site or any association with its operators.

Certain services made available via the Site are delivered by third party sites and organizations. By using any product, service or functionality originating from the Site, you hereby acknowledge and consent that we may share such information and data with any third party with whom we have a contractual relationship to provide the requested product, service or functionality on behalf of users and customers.

Third-Party Platforms and Services

Our Services may utilize third-party platforms and services (such as Ghost for website hosting and newsletters, Stripe for payment processing, or Substack for newsletter distribution). By using these platforms to access our Services, you may be subject to additional terms, conditions, or policies of those third parties. We encourage you to review their terms carefully.

By subscribing to newsletters via Substack or engaging with content distributed through Substack, you agree to be bound by these Terms in addition to Substack's terms of service. These Terms govern your relationship with Microcosm Media, LLC and Covered Parties, not Substack's relationship with you.

By streaming podcasts on Spotify, YouTube, Apple, or similar platforms ("Streaming Platforms"), or engaging with content distributed through Streaming Platforms, you agree to be bound by these Terms in addition to the respective Streaming Platform's terms of service. These Terms govern your relationship with Microcosm Media, LLC and Covered Parties, not the Streaming Platform's relationship with you.

Important Distinction: The use of third-party technical platforms to facilitate access to our Services does not mean that our gatherings, teachings, content, or relationships are governed by or subject to those platforms' terms. Your participation in gatherings, engagement with teachings, and relationship with hosts and Covered Parties are governed solely by these Terms, not by any third-party platform's terms of service, community guidelines, or policies.

Goods and Services

You are not required to pay for basic access to the Site. The Site offers, or may in the future offer, products, content, media, or services, including but not limited to: newsletters, subscriptions, memberships (free and paid), donations, tickets, books, publications, courses, tuition-based programs, folk schools, guides, promotional content, educational content, members-only areas, exclusive websites, digital communities, journals, merchandise, physical products, in-person gatherings, residencies, intensives, and/or other related content or paid media. We may limit use of these products, content, media, or services to paying users and customers of the specific product in question.

Payment, Donations, and Refund Policy

Gatherings: In-person gatherings are personal, private invitations offered in a spirit of generosity and trust. They are not commercial transactions, and attendance is not purchased. Some gatherings may request payment to cover costs, donations to support the work, or fees for tuition-based programs. Regardless of the form of payment, all such payments are final and non-refundable. You are not paying to "attend" a gathering; you are contributing to costs, supporting the work, or participating in a tuition-based program. No refunds are available for gatherings under any circumstances.

Other Products and Services: For other offerings (books, publications, courses, tuition-based programs, memberships, subscriptions, merchandise, etc.), all payments are final and non-refundable unless otherwise explicitly stated at the time of purchase. Books and publications purchased through third-party retailers are subject to the retailer's return policies, not this policy.

Donations: Donations are irrevocable gifts and are not eligible for refunds under any circumstances.

Tuition-Based Programs: Tuition is a condition of enrollment in educational programs, courses, or folk schools, analogous to academic institutions. All tuition is final and non-refundable unless explicitly stated otherwise at the time of enrollment.

Payment Terms

To access any such products and services, you ("Member") are obligated to pay the membership fee(s) ("Fees") agreed on the basis of the order you place.

All amounts are to be paid in full in the currency shown on the invoice. Member shall bear all bank and transfer charges, if any, as well as any currency conversion costs.
Orders can be paid by credit or debit card. Member may be presented with additional payment options by our payment services provider. Because we do not process these payments directly, they are subject to the availability and systems integrity of the payment processor. Member agrees to indemnify and hold harmless Microcosm Media, LLC and all Covered Parties over any technical or experiential challenges during the payment process.
If Member is an entity that is not an end user of the Product, the Parties may agree in writing that we will invoice the Customer for the fees.
Unless otherwise required by law, statements shall be made available to Member exclusively in digital form. They can only be accessed on Member's user account with our payment processor.
We reserve the right to reduce the Customer's access to the Products to the scope of use of the free version, if the Customer has not paid a due fee within seven (7) days after with or without notification. If Member settles all outstanding and due claims, access will be restored immediately, at the latest within three (3) business days after full payment is received.

In-Person Gatherings: Terms and Agreements

Nature of Gatherings

Gatherings are personal, private invitations into the hosts' homes and lives. They are not commercial events, public accommodations, or transactions. Many gatherings are offered free of charge; others may request payment to cover costs or as a gesture of commitment. Regardless of payment, all gatherings are fundamentally relational and offered in a spirit of trust and generosity.

By applying to or attending a gathering, you acknowledge that:

You are entering a private residential space as a guest, not a customer
The hosts are opening their homes, lives, and personal relationships to you
This is not a commercial transaction but a personal invitation based on mutual trust
The hosts reserve the right to decline or rescind any application or acceptance at any time, for any reason, without explanation or liability
Participation does not create any entitlement to future gatherings, communications, or continued access to hosts or Covered Parties. Future invitations, communications, and access are at the sole discretion of Microcosm Media, LLC and hosts.

Application and Acceptance

Attendance at any in-person gathering, including Weekend Intensives, Residencies, or other events, is by application and invitation only. Acceptance is at the sole discretion of Microcosm Media, LLC and the hosts. Submission of an application does not guarantee acceptance, and acceptance does not create a contractual entitlement to attend. We reserve the right to reject any application or rescind any acceptance for any reason or no reason, without notice, explanation, or liability.

Invitations and acceptances are personal and non-transferable. You may not transfer, sell, or assign your participation to another person.

Gathering Agreements

All participants in in-person gatherings must agree to and abide by the following terms:

1. Confidentiality Everything shared during the gathering is held in absolute confidence. Nothing you share, and nothing about you or other participants, will be discussed with or revealed to anyone outside the group at any time. This includes:

What participants share during the gathering
Details about the gathering itself
Information about other participants
Conversations with hosts or other attendees
Details about the hosts' homes, lives, personal circumstances, and private property
Any aspect of the gathering experience, including but not limited to: discussions, activities, off-property excursions, interactions, and the nature of the gathering itself

You agree not to post, share, publish, or broadcast any content related to the gathering on social media, blogs, podcasts, review platforms, or any other public medium without explicit prior written consent from the hosts. This includes photos, videos, posts, stories, reviews, testimonials, or any other public statements.

2. Respect and Conduct Participants must treat the space, hosts, and all other participants with care, kindness, and respect. Disruptive, harmful, or disrespectful behavior will not be tolerated. The hosts reserve the right to ask any participant to leave at any time for any reason.

3. Presence and Engagement; Electronic Devices Participants agree to maintain a device-free environment during gathering time.

Mobile phones are permitted on premises but must be powered off or set to airplane mode and stored in locations designated by hosts during gathering sessions, except during designated breaks or when explicitly permitted.

The following devices are not permitted on premises at any time unless explicitly pre-approved in writing by hosts:

Smart watches
Smart glasses or wearable cameras
Laptops, tablets, or similar computing devices
Audio or video recording devices of any kind

Participants are solely responsible for their own devices. Microcosm Media, LLC and hosts do not take custody of devices and are not liable for any loss, damage, theft, or malfunction of devices brought to gatherings, whether stored or in participant possession.

4. No Solicitation This is not a networking event. While you are welcome to share about your art, creativity, life, or career, there is to be no selling, pitching, or solicitation of any kind at any time during the gathering.

5. Substance-Free Space The gathering is a substance-free space at all times. This means you agree to avoid:

Alcohol
Recreational drugs
Smoking or vaping of any substance
Any illicit substances

6. Photography and Recording No photography, audio recording, video recording, or any other form of documentation is permitted during gatherings without explicit prior written consent from the hosts. This prohibition extends to all devices capable of capturing audio, video, or images, including but not limited to: smartphones, smart watches, smart glasses, wearable cameras, audio recorders, laptops, tablets, or any other recording device. Any recordings made without consent must be immediately deleted.

7. No Weapons For the safety and comfort of all participants, no weapons of any kind are permitted at gatherings or on the property. This includes firearms, knives (except standard eating utensils), or any object intended or used as a weapon.

Private Property Notice

Gatherings take place on private residential property, not a public venue. By attending, you acknowledge that:

You are a guest on private property
The hosts reserve the right to terminate your presence at any time
You agree to respect all house rules and boundaries communicated by the hosts
You are responsible for your own transportation to and from the property

Gathering Formats and Responsibilities

Gatherings may take different formats, including but not limited to:

Weekend Intensive: 4–6 participants, three days, self-lodging. Participants gather at a private residence. The gathering may include off-property activities (such as museums, excursions, or group travel). Participants are responsible for their own lodging and transportation to and from the property. During the gathering, hosts may arrange or provide transportation for group activities, but participation in such activities and use of such transportation is at the participant's own risk.
Residency: 1 participant, 7–9 days, hosted onsite in a private guest room. Participants are responsible for transportation to and from the property. During the residency, hosts may arrange local transportation, activities, and excursions. All such arrangements are provided as a convenience; participation is voluntary and at the participant's own risk.

Additional gathering formats, group events, or programs may be offered in the future. Specific details about lodging, transportation, activities, and other logistics will be communicated upon acceptance to each gathering.

Important: Whether on private property or during off-property activities, all participation is voluntary and at your own risk. This includes but is not limited to: group transportation arranged by hosts, excursions, public venues, and any activities outside the hosts' direct control.

Consequences of Violation

Guests who fail to observe any of the above agreements may be asked to leave the gathering at their own expense. Violations of confidentiality or substance-free policies will typically result in immediate dismissal. No refunds will be provided. Microcosm Media, LLC and the hosts reserve the right to ban individuals from future gatherings for any violation of these agreements.

Assumption of Risk for Gatherings

By attending an in-person gathering, you acknowledge and agree that:

Participation is entirely voluntary and at your own risk
You are responsible for your own physical and emotional wellbeing
You assume all risks associated with participation, including but not limited to: physical injury on the property or during off-property activities, emotional or psychological reactions to content or interactions, transportation to and from the property, transportation arranged by hosts during gatherings, excursions, public venues, and any pre-existing conditions that may be exacerbated during participation
You are responsible for your own transportation and personal expenses; lodging and local transportation responsibilities vary by gathering format as described above
Microcosm Media, LLC, the hosts, and all Covered Parties are not responsible for any injuries, emotional distress, property damage, or other harms that may occur during or as a result of participation, whether on private property or during off-property activities, including those arranged or facilitated by hosts
You release and waive any claims against Microcosm Media, LLC, the hosts, and all Covered Parties arising from your participation, including but not limited to claims related to transportation, excursions, or activities outside the hosts' direct control

No Unlawful or Prohibited Use/Intellectual Property

You are granted a non-exclusive, non-transferable, revocable license to access and use the Site strictly in accordance with these Terms. As a condition of your use of the Site and newsletters, you warrant that you will not use the Site or newsletters for any purpose that is unlawful or prohibited by these Terms. You may not use the Site in any manner which could damage, disable, overburden, or impair the Site or interfere with any other party's use and enjoyment of the Site or newsletters. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through the Site or newsletters.

All content included as part of the Service, such as text, graphics, logos, images, concepts, ideas, writing, art, content, as well as the compilation thereof, and any software used on the Site, is the property of Microcosm Media, LLC or its suppliers, members, or owners, and protected by copyright and other laws that protect intellectual property and proprietary rights. You agree to observe and abide by all copyright and other proprietary notices, legends or other restrictions contained in any such content and will not make any changes thereto.

You will not modify, publish, transmit, reverse engineer, participate in the transfer or sale, create derivative works, or in any way exploit any of the content, media, or ideas, in whole or in part, found on the Site or newsletters. Content is not for resale. Your use of the Site does not entitle you to make any unauthorized use of any protected content, and in particular you will not delete or alter any proprietary rights or attribution notices in any content. You will use protected content solely for your personal use, and will make no other use of the content without the express written permission of Microcosm Media, LLC and the copyright owner. You agree that you do not acquire any ownership rights in any protected content. We do not grant you any licenses, express or implied, to the intellectual property of Microcosm Media, LLC or our licensors except as expressly authorized by these Terms.

Prohibition on AI and Machine Learning Use

You may not recreate or attempt to recreate the content, or the stylistic, artistic, structural, or related elements of content on the Site or newsletters in any way. You may not use software, websites, chatbots, large language models, generative transformers, artificial intelligence, or other tools to analyze, save, alter, attempt to replicate, or develop derivative works based on the ideas, content, and stylistic, artistic, tonal, structural, or related elements of work and media produced by the Site, for any use, including personal. In addition, you may not use content produced by the Site to train chatbots, language models, generative transformers, artificial intelligence, or other tools, and agree never to do so.

Further Prohibition of Data Scraping

You explicitly acknowledge and agree that data scraping, web scraping, data mining, digital, machine, and language model training, or any similar data extraction activities from the website, whether automated or manual, are strictly prohibited.

You shall not use any software, scripts, or other automated methods to extract, gather, scrape, or retrieve data from the website, including but not limited to writing, prose, descriptions, designs, product information, pricing details, user profiles, information about the organization, or any other content. This prohibition extends to any physical published works (for example, books), digital works (for example, applications or ebooks) or works distributed through other digital channels (like email newsletters).

In addition, you may not, under any circumstances, whether as an individual, an organization, through others, or via a third party, copy, approximate, or procure any of the above content to feed to large data models, data machines, automated processes, or artificial intelligences, however they may be defined.

Contributor Content

The Site publishes contributed content from invited authors, interviewees, and other contributors. By submitting content for publication — whether in the form of written articles, essays, interview responses, quotes, images, artworks, videos, or other materials — you grant Microcosm Media, LLC a non-exclusive, perpetual, royalty-free, worldwide license to edit, publish, reproduce, distribute, and display that content on the Site, in newsletters, on social media, and in any other medium or format, whether now known or later developed. We retain full editorial discretion over all contributed content, including the right to edit for clarity, length, tone, and consistency with our editorial standards. Publication of contributed content does not create an employment, partnership, or agency relationship between us and the contributor. Contributors retain ownership of their original work, subject to the license granted herein.

International Users

The Service is controlled, operated and administered by Microcosm Media, LLC from our offices within the United States. If you access the Service from a location outside the USA, you are responsible for compliance with all local laws. You agree that you will not use content accessed through the Site in any country or in any manner prohibited by any applicable laws, restrictions or regulations.

Force Majeure

Microcosm Media, LLC and Covered Parties shall not be liable for any failure or delay in performing any obligation under these Terms or in providing any Service, gathering, or other offering due to causes beyond our reasonable control, including but not limited to: natural disasters and extreme weather events (including acts of God), pandemics, epidemics, government restrictions or mandates, war, terrorism, civil unrest, labor disputes, technical failures, power outages, transportation disruptions, illness or incapacity of hosts or key personnel, or any other circumstance that makes performance impossible, impracticable, or unsafe.

In the event of such circumstances, we may, at our sole discretion: (a) cancel or postpone any gathering, program, or Service; (b) provide alternative arrangements (including virtual or remote participation); or (c) modify the format, location, or timing of any offering. No refund shall be required for any modification made due to force majeure circumstances, though we may, at our discretion, offer credits or other accommodations.

Disclaimers and Limitation of Liability

No Professional Advice

All content published or developed by the Site is meant solely for informational, educational, spiritual, or entertainment purposes. Nothing we share should be construed as:

Financial or legal advice
Medical advice, diagnosis, or treatment
Mental health advice, therapy, or psychological treatment
Professional counseling of any kind

Spiritual and Emotional Content

If you are unsure about your capacity to participate safely in gatherings or to engage with spiritual or personal development content, you agree to first consult with a qualified medical, mental health, or other appropriate professional. By participating, you represent that you have assessed your own capacity and are choosing to participate voluntarily.

No Guarantees

We make no guarantees, representations, or warranties about any specific outcomes, results, or benefits from using our Services, attending gatherings, or engaging with our content. Individual experiences may vary.

Assumption of Risk

By using the Site or participating in any Services, you expressly agree that:

Your use is at your sole risk
The Site and Services are provided on an "AS IS" and "AS AVAILABLE" basis
Microcosm Media, LLC and all Covered Parties shall not be liable for any errors, omissions, or delays in content or Services
You are solely responsible for any damage to your computer system or loss of data resulting from use of the Site

Indemnification

You agree to indemnify, defend, and hold harmless Microcosm Media, LLC and all Covered Parties from any losses, costs, liabilities, damages, expenses, or claims (including reasonable attorneys' fees) relating to or arising out of:

Your use of or inability to use the Site, newsletters, products, or services
Your participation in any gatherings, events, or activities
Any content, postings, or communications made by you
Your violation of any terms of this Agreement
Your violation of any rights of a third party
Your violation of any applicable laws, rules, or regulations
Any injury, damage, or harm caused by you to the property, hosts, or other participants
Any false, misleading, or defamatory statements made by you about Microcosm Media, LLC, Covered Parties, or other participants, whether online, offline, or on social media
Any breach of confidentiality, including sharing private information about gatherings, hosts, or participants on social media or other public platforms
Any claims arising from your attendance at or participation in gatherings, including but not limited to: physical injury, emotional distress, property damage, or allegations of misconduct by Covered Parties

We reserve the right, at our own cost, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will fully cooperate with us in asserting any available defenses.

Release of Liability and Waiver of Claims

General Release: By using the Site or participating in any Services or gatherings, you hereby release, waive, and discharge Microcosm Media, LLC and all Covered Parties from any and all claims, demands, damages, or causes of action (known or unknown) arising out of or related to:

Your use of the Site or Services
Your participation in any gatherings, events, or activities
Any content, teachings, or materials provided through the Site or Services
Any interactions with hosts, participants, or Covered Parties
Any physical, emotional, or psychological reactions you may experience

Injury and Property Damage: You specifically release and waive any claims related to:

Physical injury or bodily harm occurring on the property or during gatherings
Damage to your personal property
Transportation to or from gatherings
Pre-existing conditions that may be exacerbated during participation
Dietary reactions or allergies (you are responsible for communicating your needs and managing your own health)

Emotional and Psychological Reactions: You acknowledge that spiritual, educational, and personal development work may evoke strong emotional or psychological responses. You assume full responsibility for such responses and waive any claims against Covered Parties arising from your reactions to content, interactions, or experiences.

Non-Disparagement

You agree not to make any public statements, posts, reviews, or communications that disparage, criticize, or harm the reputation of Microcosm Media, LLC, Covered Parties, or other participants. This includes but is not limited to: social media posts, online reviews, blog posts, podcast appearances, media interviews, or communications with third parties. This obligation survives termination of your participation in any gathering or use of the Services.

Arbitration and Dispute Resolution

Mandatory Arbitration

In the event the parties are not able to resolve any dispute between them arising out of or concerning these Terms and Conditions, or any provisions hereof, whether in contract, tort, or otherwise at law or in equity for damages or any other relief, then such dispute shall be resolved only by final and binding arbitration pursuant to the Federal Arbitration Act, conducted by a single neutral arbitrator and administered by the American Arbitration Association, or a similar arbitration service selected by the parties, in a location mutually agreed upon by the parties. The arbitrator's award shall be final, and judgment may be entered upon it in any court having jurisdiction.

In the event that any legal or equitable action, proceeding or arbitration arises out of or concerns these Terms and Conditions, the prevailing party shall be entitled to recover its costs and reasonable attorney's fees. The parties agree to arbitrate all disputes and claims in regards to these Terms and Conditions or any disputes arising as a result of these Terms and Conditions, whether directly or indirectly, including Tort claims that are a result of these Terms and Conditions. The parties agree that the Federal Arbitration Act governs the interpretation and enforcement of this provision. The entire dispute, including the scope and enforceability of this arbitration provision shall be determined by the Arbitrator. This arbitration provision shall survive the termination of these Terms and Conditions.

This arbitration requirement applies to all disputes arising from the Site, Services, or gatherings, including disputes with Microcosm Media, LLC and any Covered Parties.

Class Action Waiver

Any arbitration under these Terms and Conditions will take place on an individual basis; class arbitrations and class/representative/collective actions are not permitted. THE PARTIES AGREE THAT A PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN EACH'S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PUTATIVE CLASS, COLLECTIVE AND/OR REPRESENTATIVE PROCEEDING, SUCH AS IN THE FORM OF A PRIVATE ATTORNEY GENERAL ACTION AGAINST THE OTHER. Further, unless both you and Microcosm Media, LLC agree otherwise, the arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of a representative or class proceeding.

Confidentiality of Disputes

All disputes arising under these Terms shall be treated as confidential. Neither party shall disclose the existence or details of any dispute, arbitration, or settlement to any third party, except as required by law or to enforce an arbitration award.

Survival

The following sections shall survive termination of these Terms, expiration or completion of any Service or gathering, or cessation of your use of the Site:

Governing Law and Jurisdiction
This Survival Clause

Any claims, liabilities, or obligations arising prior to termination shall also survive termination.

Termination/Access Restriction

Microcosm Media, LLC reserves the right, in its sole discretion, to terminate your access to the Site and the related services, newsletters, email communications, or any portion thereof at any time, without notice.

To the maximum extent permitted by law, this agreement is governed by the laws of the Commonwealth of Virginia, and you hereby consent to the exclusive jurisdiction and venue of courts in Virginia in all disputes arising out of or relating to the use of the Site. Use of the Site is unauthorized in any jurisdiction that does not give effect to all provisions of these Terms, including, without limitation, this section.

You agree that no joint venture, partnership, employment, or agency relationship exists between you and Microcosm Media, LLC as a result of this agreement or use of the Site. Our performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of our right to comply with governmental, court and law enforcement requests or requirements relating to your use of the Site or information provided to or gathered by us with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.

In the event you are unable to access the site or any related services, including newsletters, paid or unpaid, you assume full responsibility for any potential damages or losses incurred. You agree Microcosm Media, LLC bears no responsibility for factors beyond our control which may or may not affect your ability to access our site and related services. In such an event, purchases or subscriptions to the site and any and all related services or newsletters are non-refundable.

Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and Microcosm Media, LLC with respect to the Site and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and the Site with respect to the Site. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish to the parties that this agreement and all related documents be written in English.

Changes to Terms

Microcosm Media, LLC reserves the right, in its sole discretion, to change the Terms under which the Site is offered. The most current version of the Terms will supersede all previous versions. We encourage you to periodically review the Terms to stay informed of our updates.
